User Agreement
The Artfor’s (Company) offers the User Services (Services) of the Site on the terms and conditions that are the subject of this Agreement on the use of the theartfors.com website. In this regard, the User must carefully read the terms of this Agreement, which are considered by the Company as a public offer.
1. General conditions
1.1 The use of materials and services of the Site is governed by the current legislation of the Russian Federation.
1.2 This Agreement is a public offer. The user is considered to have acceded to this Agreement by gaining access to the materials of the Site.
1.3 The Site Administration has the right to unilaterally change the terms of this Agreement at any time. Such changes come into force from the moment the new version of the Agreement is posted on the website. If the User does not agree with the changes made, he is obliged to refuse access to the Site, stop using the services and materials of the Site.
2. Terms and definitions

2.2 Website, Resource, Portal - Internet resource theartfors.com.
2.3 Administration - employees of the Company, as well as persons duly authorized by the Company to manage the Site and provide Services to Users, as part of the use of the Site by the latter.
2.4 Services - a set of computer programs, databases that ensure the operation of the Site, as well as a set of Services provided to Users when using the Site.
2.5 Visitor - any person using the Site.
2.6 User - a Visitor who has passed the registration procedure. The term User in this Agreement refers to both the Auctioneer and the Participants.
2.7 Login - a unique account identifier (mobile phone number or email address) specified by the User during registration and used by him in the process of using the Site. It is forbidden to register and use several Logins by the same Visitor.
2.8 Password - a conditional word or set of characters chosen by the User and, together with the Login, ensures his identification when using the Resource.
2.9 Auction - an auction scheduled for a certain dates, in which interested participants compete in the proposed price for the goods being sold. The price of the lot is set in one of the available currencies - US Dollars, Euros, Russian Rubles. The item is sold to the bidder who has set the maximum bid at the end of the auction.
2.10 Participant - a user, a capable person over 18 years old, participating in auctions.
2.11 Buyer - a Participant, a capable person over 18 years of age, who placed the maximum bid at the end of the auction and confirmed it by payment.
2.12 Starting price - the price of the lot, declared on the Site at the opening of the auction.
2.13 Lot - a work of art posted on the Site and addressed to the Participants.
2.14 Bid - the declared price of the lot by the Buyer during the auction. The bid may be higher than the Initial price of the lot.
2.15 Lot price - the maximum bid at the end of the auction.
2.16 Accounting time — Moscow time. All dates indicated when using the Site and Services are taken into account in Moscow time.
2.17 Acceptance of the offer - full and unconditional acceptance by the Visitor of the Agreement on the use of the theartfors.com Resource by carrying out any actions to use the theartfors.com Site.
2.18 This Agreement may use terms not defined in Section 1 of the Agreement. In this case, the interpretation of such a term is made in accordance with the text of the Agreement. In the absence of an unambiguous interpretation of the term in the text of the Agreement, one should be guided by the interpretation of the term defined: first of all - by the legislation of the Russian Federation, secondly - on the theartfors.com Website, then - established on the Internet.
3. Registration on the Platform
3.1 Registration of the User on the Platform is free and voluntary.
3.2 The User of the Site is a capable natural person registered on the Platform in accordance with the procedure established by these Rules, who has reached the age of 18 years.
3.3 When registering on the Platform, the User is obliged to provide the Site Administration with the necessary reliable and up-to-date information for the formation of the User's personal page, including a unique phone number for each User, an email address and a password for accessing the Platform, as well as a name or pseudonym. The registration form of the Platform may request additional information from the User.
3.4 The user is fully responsible for the accuracy, relevance and completeness of the information provided during registration.
3.5 The email address (or phone number) and password specified by the User during registration are necessary and sufficient information for the User to access the Platform. The user has no right to transfer his login and password to third parties and bears full personal responsibility for their safety.
3.6 The User has the right to independently delete or change information previously posted by the User, if it is not blocked.
4. The procedure for conducting an online auction
4.1 The auction is conducted by increasing the initial price of the auction item (“auction step”), while the “auction step” is set by the auctioneer.
4.2 Online participants in the auction increase the bid on the sitetheartfors.com using the "Place a bid" button as a sign of agreement to purchase the lot at a price increased by the value of the selected "auction step".
4.3 The placed bid online is a confirmation of the conclusion of the contract for the purchase of an object of art, as well as confirmation of the provision of services by the Company.
4.4 The winner of the auction is the Bidder who offered a higher price for the auction lot at the end of the auction.
4.5 The organizers of the auction reserve the right to request financial guarantees from the bidder.
4.6 A protocol on the results of the auction is not drawn up due to the technical features of the auction.
4.7 In addition to the price of the purchased lot, the Auction Participant does not pay additional commissions to the Company.
5. Rights and obligations of the parties
5.1 The user has the right:
5.1.1. use all the services available on the Site, as well as purchase any Goods and Services offered on the Site.
5.1.2. ask any questions related to the services of the site by email: info@theartfors.com
5.1.3. use the Site solely for the purposes and in the manner provided for by the Agreement and not prohibited by the legislation of the Russian Federation.
5.1.4. require the administration to hide any information about the user.
5.2. The user undertakes:
5.2.1 comply with the Rules for holding an auction on the theartfors.com Platform, as well as the rules for providing information by users of theartfors.com; strictly comply with the requirements of the current legislation of the Russian Federation or other territory in which the Lots are carried out or placed, including the rules for the export of cultural property from the territory of the Russian Federation;
5.2.2 refrain from copying in any other form, as well as from reproduction, modification, addition, distribution (including public demonstration), use for commercial or other purposes of the content of the Site (as well as any part thereof), refrain from creating derivative objects based on it without the prior written permission of the Administration;
5.2.3. not use any devices or computer programs to interfere or attempt to interfere with the normal functioning of the theartfors.com Platform;
5.2.4 refrain from any actions leading to excessive or unreasonable loading of the theartfors.com Platform infrastructure.
5.2.5. provide, at the request of the Site Administration, additional information that is directly related to the services provided by this Site.
5.2.6. observe the property and non-property rights of authors and other copyright holders when using the Site.
5.2.7. not to distribute using the Site any confidential and protected by the legislation of the Russian Federation information about individuals or legal entities.
5.2.8. avoid any actions that may violate the confidentiality of information protected by the legislation of the Russian Federation.
5.2.9. do not use the Site to distribute information of an advertising nature, except with the consent of the Site Administration.
5.2.10. Do not use the services for the purpose of:
5.2.10.1. violation of the rights of minors and causing harm to them in any form.
5.2.10.2. infringement of the rights of minorities.
5.2.10.3. representing yourself as another person or representative of an organization and community without sufficient rights, including for the employees of this site.
5.2.10.4. misrepresenting the properties and characteristics of any Goods or services posted on the Site.
5.2.10.5. incorrect comparison of the Goods or Services, as well as the formation of a negative attitude towards persons (not) using certain Goods and services, or condemnation of such persons.
5.2.10.6. uploading content that is illegal, violates any rights of third parties; promotes violence, cruelty, hatred, or discrimination on racial, national, sexual, religious, social grounds; contains false information, or insults to specific individuals, organizations, authorities.
5.2.10.7. inducement to commit unlawful acts, as well as assistance to persons whose actions are aimed at violating the restrictions and prohibitions in force on the territory of the Russian Federation.
5.2.11. ensure the accuracy of the information provided
5.2.12. ensure the safety of personal data from access by third parties.
5.3 The user is prohibited from:
5.3.1. use any devices, programs, procedures, algorithms and methods, automatic devices or equivalent manual processes to access, acquire, copy or monitor the content of the Site.
5.3.2. interfere with the proper functioning of the Site.
5.3.3. circumvent the navigation structure of the Site in any way to obtain or attempt to obtain any information, documents or materials by any means that are not specifically provided by the services of this Site.
5.3.4. unauthorized access to the functions of the Site, any other systems or networks related to this Site, as well as to any services offered on the Site.
5.3.5. violate the security or authentication system on the Site or on any network related to the Site.

5.4 The Company undertakes:
5.4.1. place bids for Users registered on the theartfors.com Platform, ensure their participation in the auction for the right to purchase a lot;
5.4.2. not provide information received from Users (including email address and phone number) to third parties for sending unsolicited commercial information ("spam");
6. Obligations of the User
6.1 The User agrees not to take actions that may be considered as violating the laws of the Russian Federation or international law, including in the field of intellectual property, copyright and / or related rights, as well as any actions that lead or may lead to a violation of the normal operation of the Site and services of the Site, as well as actions not provided for by the Terms of Participation for the buyer located on the Site;
6.2 The use of the materials of the Site without the consent of the copyright holders is not allowed. For the legitimate use of the materials of the Site, it is necessary to conclude license agreements (obtain licenses) from the Copyright Holders;
6.3 When quoting materials from the Site, including copyrighted works, a link to the Site is required;
6.4 The User is warned that the Site Administration is not responsible for visiting and using external resources, links to which may be contained on the Site;
6.5 The User agrees that the Site Administration is not responsible and has no direct or indirect obligations to the User in connection with any possible or arising losses or damages associated with any content of the Site, copyright registration and information about such registration, goods or services available on or obtained through external sites or resources or other contacts of the User, which he entered using the information posted on the Site or links to external resources.
7. Special conditions
7.1 The Company does not warrant that the software of the Services and the Site will be error-free or will function uninterrupted.
7.2 The Company is not responsible for losses or other damage incurred by the User due to the actions of third parties.
8. Entry into force and procedure for amending this Agreement
8.1 The Agreement, Annexes to the Agreement and amendments to them come into force from the moment they are published on the pages of the theartfors.com website
8.2 Changes to the Agreement and Annexes to the Agreement may be made at any time.
8.3 The User and/or Visitor undertakes to familiarize themselves with the current version of the Agreement before each use of the Resource, Services and/or Services of the Company.
8.4 If the User and/or the Visitor decides not to agree with the amended Agreement, then he is obliged to refuse to use the Service.
8.5 The User confirms that he is familiar with all the clauses of this Agreement and unconditionally accepts it.
9. Information processing
The Company processes information about Users, including their personal data, in order to fulfill the Company's obligations to Users regarding the use of the Site and its Services in accordance with the Privacy Policy published on the site at: theartfors.com/policy
10. Responsibility
10.1. Any losses that the User may incur in the event of intentional or careless violation of any provision of this Agreement, as well as due to unauthorized access to communications of another User, are not reimbursed by the Site Administration.
10.2. The site administration is not responsible for:
10.2.1. delays or failures in the process of making a transaction that have arisen due to force majeure, as well as any case of malfunctions in telecommunications, computer, electrical and other related systems.
10.2.2. actions of transfer systems, banks, payment systems and for delays associated with their work.
10.2.3. proper functioning of the Site, if the User does not have the necessary technical means for its use, and also does not bear any obligations to provide users with such means.
11. Violation of the terms of the user agreement
11.1. The site administration has the right to disclose information about the User if the current legislation of the Russian Federation requires or permits such disclosure.
11.2. The Site Administration has the right, without prior notice to the User, to terminate and (or) block access to the Site if the User has violated this Agreement or the terms of use of the Site contained in other documents, as well as in the event of termination of the Site or due to a technical malfunction or problem.
11.3. The Site Administration is not liable to the User or third parties for termination of access to the Site in case of violation by the User of any provision of this Agreement or other document containing the terms of use of the Site.
12. Dispute Resolution
12.1. In the event of any disagreements or disputes between the Parties to this Agreement, a prerequisite before going to court is the presentation of a claim (a written proposal for a voluntary settlement of the dispute).
12.2. The recipient of the claim, within 30 calendar days from the date of its receipt, notifies the claimant in writing of the results of the consideration of the claim.
12.3. If it is impossible to resolve the dispute on a voluntary basis, any of the Parties has the right to apply to the court for the protection of their rights, which are granted to them by the current legislation of the Russian Federation.
12.4. Any claim regarding the terms of use of the Site must be filed within 5 days after the grounds for the claim arise, with the exception of copyright protection for the materials of the Site protected in accordance with the law. In case of violation of the conditions of this paragraph, any claim is left by the court without consideration.
13. Final provisions
This Agreement implies the conclusion of an agreement between the User and the Company regarding the procedure for using the Site and its Services, and replaces all previous agreements between the User and the Company.
In the event of any disputes or disagreements related to the execution of this Agreement, the User and the Company will make every effort to resolve them through negotiations between them. In the event that disputes are not resolved through negotiations, disputes shall be resolved in the manner prescribed by the current legislation of the Russian Federation.
The User is obliged to fully familiarize himself with this Agreement before registering on the Site. Registration of the User on the Site means the full and unconditional acceptance by the User of this Agreement in accordance with Art. 438 of the Civil Code of the Russian Federation.
This Agreement comes into force for the User from the moment of its accession to it and is valid for an indefinite period.
The site administration does not accept counter offers from the User regarding changes to this User Agreement.

5.3 The user is prohibited from:

5.4.1. place bids for Users registered on the theartfors.com Platform, ensure their participation in the auction for the right to purchase a lot;
5.4.2. not provide information received from Users (including email address and phone number) to third parties for sending unsolicited commercial information ("spam");
6. Obligations of the User
6.1 The User agrees not to take actions that may be considered as violating the laws of the Russian Federation or international law, including in the field of intellectual property, copyright and / or related rights, as well as any actions that lead or may lead to a violation of the normal operation of the Site and services of the Site, as well as actions not provided for by the Terms of Participation for the buyer located on the Site;
6.2 The use of the materials of the Site without the consent of the copyright holders is not allowed. For the legitimate use of the materials of the Site, it is necessary to conclude license agreements (obtain licenses) from the Copyright Holders;
6.3 When quoting materials from the Site, including copyrighted works, a link to the Site is required;
6.4 The User is warned that the Site Administration is not responsible for visiting and using external resources, links to which may be contained on the Site;
6.5 The User agrees that the Site Administration is not responsible and has no direct or indirect obligations to the User in connection with any possible or arising losses or damages associated with any content of the Site, copyright registration and information about such registration, goods or services available on or obtained through external sites or resources or other contacts of the User, which he entered using the information posted on the Site or links to external resources.
7. Special conditions
7.1 The Company does not warrant that the software of the Services and the Site will be error-free or will function uninterrupted.
7.2 The Company is not responsible for losses or other damage incurred by the User due to the actions of third parties.

The Site Administration has the right, without prior notice to the User, to terminate and (or) block access to the Site if the User has violated this Agreement or the terms of use of the Site contained in other documents, as well as in the event of termination of the Site or due to a technical malfunction or problem.
11.3. The Site Administration is not liable to the User or third parties for termination of access to the Site in case of violation by the User of any provision of this Agreement or other document containing the terms of use of the Site.
12. Dispute Resolution
12.1. In the event of any disagreements or disputes between the Parties to this Agreement, a prerequisite before going to court is the presentation of a claim (a written proposal for a voluntary settlement of the dispute).
12.2. The recipient of the claim, within 30 calendar days from the date of its receipt, notifies the claimant in writing of the results of the consideration of the claim.
12.3. If it is impossible to resolve the dispute on a voluntary basis, any of the Parties has the right to apply to the court for the protection of their rights, which are granted to them by the current legislation of the Russian Federation.
12.4. Any claim regarding the terms of use of the Site must be filed within 5 days after the grounds for the claim arise, with the exception of copyright protection for the materials of the Site protected in accordance with the law. In case of violation of the conditions of this paragraph, any claim is left by the court without consideration.
13. Final provisions
This Agreement implies the conclusion of an agreement between the User and the Company regarding the procedure for using the Site and its Services, and replaces all previous agreements between the User and the Company.
In the event of any disputes or disagreements related to the execution of this Agreement, the User and the Company will make every effort to resolve them through negotiations between them. In the event that disputes are not resolved through negotiations, disputes shall be resolved in the manner prescribed by the current legislation of the Russian Federation.
The User is obliged to fully familiarize himself with this Agreement before registering on the Site. Registration of the User on the Site means the full and unconditional acceptance by the User of this Agreement in accordance with Art. 438 of the Civil Code of the Russian Federation.
This Agreement comes into force for the User from the moment of its accession to it and is valid for an indefinite period.
The site administration does not accept counter offers from the User regarding changes to this User Agreement.
